    it is around $27 and I got both H1 and EAD.

    It is a huge difference.

    Are you getting like $150/hr rate?

    What do you do?

    You dont have to apply for a COS as long as she is leaving US before her current I-94 expires. However, note that when she goes for her H4 interview, she might be asked to prove her H1 status by showing her employment details (recent pay checks, tax documents..) in addition to your employment documents before they give her the H4 Visa...This happened with one of my friends at Chennai embassy...Just wanted to give you a heads up on that....

    both . copy of i94 original + approval notice . is shd have the same number if u have not travelled outside

    I have 2 H1B Transfer questions for clarification.
    1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?
    2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.

    I appreciate members response.

    Hi Guys,
    I have few questions.
    I applied my Greencard under EB-3 Category and my labour was approved on Jul'2007. My priroity date is 25th June'2007.
    Applied I140 & I485 concurrently and I140 was approved on Sep2007. Both myself and my wife got EAD's. Currently my wife is on EAD and still I am on H1-B.

    Now I got another offer from fortune consulting company and I am planning to shift by using H1B transfer.

    Steps to take care
    Offer letter should contain same job title and same job duties. What else do I need to take care?

    Some of my friends told not to submit AC21 and some of them told me to submit AC21 without fail.

    Can my company withdraw my approved I140(was approved 2007) is it possible to do that?

    Please let me know. I am in a very confused state weather to accept new offer or not.

    I think you get AP in out of Country when you are applying.

    I'm in same boat as you couple of months of back and i canceled my trip as I got advise from Expert (Attorney) that AP's approved when out of country are not valid.

    You are not mandated to report on AC21 (job change) so my advice is not to report it till USCIS ask's you.

    For address change. Yes you need to report that. But if you can retain your current address for just this one month and perhaps commute (fly) to your new job you can take a chance. Just my advice

    Hi people, I am currently applying change of status from H1 to F1. Since my PERM got audit, and my h1 visa is going to expire in the end of January 2009, I need to change my status to F1 student visa in order to stay in the U.S legally. Now, I am trying to fill out the form I-539 by myself, and I got confused on:
    part 4. additional information on 3g:"Have you, or any other person included in this application, been employed in the U.S. since last admitted or granted an extension or change of status?"
    I don't know should I put "YES" or "NO", I have never done "i-539 for change of status" on my first F1/OPT to H1 visa....but I actually worked in the U.S...
    Can anyone help me to answer that? thanks a lot!!!

    Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
    Effective January 4, 2010, the U.S. Department of Health and Human Services, Center for Disease Control and Prevention (HHS/CDC) is removing HIV from the list of communicable diseases of public health significance and references to HIV from the scope of medical examinations for foreign nationals.

    Until the rule goes into effect, non-citizens who are HIV-positive cannot be admitted into the U.S. unless the U.S. Department of Homeland Security (DHS) grants a waiver. Once the rule goes into effect on January 4, 2010, HIV infection will no longer be defined as a communicable disease of public health significance, immigrant visa applicants who are required to undergo a medical screening exam will no longer be tested for HIV, a waiver for entry into the U.S. will no longer be necessary, and HIV-positive visa applicants will not be found ineligible for visas under Section 212(a)(1)(A)(i) of the Immigration and Nationality Act (INA). Although foreign nationals with HIV who apply for visas will no longer be ineligible under INA Section 212(a)(1)(A)(i), they still must overcome the public charge under INA Section 212(a)(4) by demonstrating to the consular officers that they will have the means of support in the U.S. and that they will not need to seek public financial assistance.     Guys/Gals,

    Do you know that if i become a named Plaintiff in 485 fiasco lawsuit and the lawsuit drags for a Year ( just vague timeline) does that imapairs my ability to file a fresh new 485 application if my PD becomes CURRENT ?

    I'm also assuming that USCIS would not return my Package sent on July 2nd since i'm the middle of a live lawsuit as a plaintiff.

    Thoughts ? Knowledges ?

    Hello,
    I am working with A on h1b and the visa expires on May 1st 2010.
    Recently I got another offer with B and they filed my h1b transfer (regular).
    The offer they gave me verbally is different from what's on the offer letter, when I contacted them there insist that they never "promised" , so I did not want to take that offer now.
    Can I now ask employer A to file the extension and continue working with A?. Will that create any issues if the transfer with B gets Approved/rejected?. or is there any alternate?. Please help.

    There is nothing like H1 transfer. Each petition is separate. Company B filing H1 does not invalidate your H1 from Company A. Your original H1 will still be valid even if H1 from company B is approved/denied. You can just continue working with company A and file extension when its due...

    Myself(Husband) & mywife both came on H1B from same employer.
    My son got H4 visa through my wife H1B visa.
    I (Husband) applied for green card and got EAD for myself & mywife , got Advance parole for myself, mywife & myson and are in 485 pending AOS status,
    My Wife is taking permanent job with EAD (EAD is through my Greencard process)
    If employer cancels my wife H1B she will come to EAD status.
    I am not sure what will be the status of my son who is currently on H4 visa through my wife H1B visa.
    My son got Advance Parole and 485 pending status through my green card.
    Do I need to apply for H4 visa for my son or will my son be ok on pending AOS status ?
